 REGISTROS DE MUSICAS,  REGISTRATION IN ASSOCIATIONS TO GENERATE ISRC AND SEND TO ECAD:

The registration can be made for musical compositions, lyrics, music scores and musical arrangements at the National Library or at the UFRJ School of Music and serves as an indication of proof of authorship, as well as to specify the author(s), specify the moral and patrimonial rights of the musical work and to establish the duration of the terms of protection of the work for the author(s) and his/her successor(s).

It is important to make it clear that the creator's copyright on his work does not depend on the registration or registration, the registration serves as a form of protection and proof of prior art in the event that someone claims to be the “true” author of a work. The record serves as a certificate of the work's existence, associating it with author(s) and date of creation.

Remember that the registration of a work does not guarantee the distribution of copyright income to its authors, since there is no connection between the database of the National Library and the UFRJ School of Music with ECAD.

First of all, we remind you that whoever can register a musical work or a phonogram in the copyright collection and distribution system in Brazil (ECAD) is the holder of the right to the work or phonogram.

Furthermore, it is important to point out that even if the musical work and the phonogram are correctly registered in the ECAD, in order for the holder of the copyright or related right to receive remuneration for public performance, he must be affiliated to one of the 7 associations that integrate ECAD, otherwise you will not be able to receive.

How to register the work?

If the musical work is not edited, the author can register the work, who must access the website of the association to which he is affiliated, search for the work registration form, fill it in with the title of the work, his and your stage name and send the signed form to the association. If the work has a partnership, you must inform the percentage of authorship of the work of each one as agreed with the partner.

If the work is edited, the author's publisher will send the form containing the same information to the association to which it is affiliated, only distinguishing it from the previous one due to the addition of the information on the publisher's own remuneration percentage freely stipulated between author and publisher in the contract.

Heads up! It is important that co-authorship partners of a musical work communicate at the time of registration to avoid the so-called duplicate registration, which occurs when two rights holders send two requests for registration of the same work, whether the two authors, author and publisher or publishers of different authors.

When the duplicate registration occurs, ECAD blocks both registrations and does not distribute the amounts collected for that work until the duplicity is resolved, which may take some time for someone to verify this occurrence.

How to register the phonogram?

It is always done by the phonographic producer, who is the individual or legal entity responsible for the recording, which may be the performer himself, a record company or third parties.

Please note that if you are an independent artist, you must also join your association as a phonographic producer in order to register your phonograms.

To register, the applicant must contact the association to which he is affiliated and ask which method it uses. Currently, there are associations that allow the registration of phonograms through their virtual portals on the internet, others guide the associate to use the SISRC software and send the file exported by the program in the "IMP" format and others request that the member send the form also generated by the SISRC in “pdf” format signed by the phonographic producer.

Regardless of the format used by the association, information on performers, musicians and phonographic producers will always appear in each phonogram record.

Each phonogram will generate a unique and unique number from the international standard phonogram code called ISRC which follows the format below:

ISRC format: BR-XXX-19-00001
BR = Country where the phonogram was recorded.
XXX = Code that identifies the phonographic producer (owner of the phonogram).
19 = Identifies the year of publication.
00001 = Automatic sequential recording identification number.

ISRC: register the work and then create its phonogram.

Now it is possible to generate the ISRC (identity of the song or work)  on line in the Abramus Portal. 

Important: only the phonographic producer can register ISRC. The producer is responsible for

ISRCs that, after being generated in ABRAMUS, will be automatically sent to ECAD

responsible for inspecting the performances of the phonograms, where he will transfer the copyright

of the author's music.

AGGREGATORS: They are  distributors who send   to digital platforms ex Tratore,

Spotiy, Deezer for streaming or sell your albums or singles.

In order to receive your copyright when your songs are played publicly, it is essential to be affiliated with one of the seven associations that administer Ecad and to keep the repertoire up to date. In addition, the music must be played by a non-defaulting customer and this performance must be captured by Ecad or informed in spreadsheets or musical scripts delivered by promoters. ​

The registration of unpublished songs (lyrics and sheet music) can be done at the Copyright Office of the National Library and at the National School of Music at UFRJ. Both entities are authorized to receive the registration of musical works, according to Law nº 9.610 of February 19, 1998
